mobile application and website (collectively, the “Platform”).

These Terms & Conditions (“Terms”) govern your access to and use of the Platform, including the services, features, content and functionality made available through it.

By accessing, registering on, or using the Platform, you acknowledge that you have read, understood and agreed to these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the Platform.

1. About the Platform

The Platform is owned and operated by Sri Srinivasa Hospital (Unit of Marthala Hospitals Pvt. Ltd.), having its registered office at 17-1, 380/E/28 & 32, C. E. Colony, Saidabad, Santosh Nagar, Hyderabad, Telangana 500059 (“Hospital”, “we”, “us” or “our”).

The Platform is intended to provide patients and users with convenient access to certain healthcare-related and hospital-related services, which may include:

  • Appointment booking and management;
  • Doctor and department information;
  • Online consultations, where available;
  • Access to prescriptions, reports and other medical records, where applicable;
  • Laboratory and diagnostic services;
  • Pharmacy and medicine-related services;
  • Home healthcare services, where available;
  • Digital payments;
  • Health-related reminders and notifications;
  • Patient communication and support;
  • Access to hospital offers, benefits or loyalty programmes;
  • Other services made available by the Hospital from time to time.

The availability of any particular service may vary depending on the Hospital’s facilities, location, doctor availability, applicable laws and other operational considerations.

 

 

2. Technology Platform Provider

The Hospital has entered into an agreement with Pocezy Technologies (“Fyndbetter”) for the design, development, deployment, hosting, maintenance, support and/or provision of technology infrastructure and services relating to the Platform.

Fyndbetter acts as the Hospital’s technology and platform service provider and may process information on behalf of the Hospital in accordance with the Hospital’s instructions, applicable contractual arrangements and applicable law.

Unless expressly stated otherwise, the healthcare services provided through the Platform are provided by the Hospital and/or the relevant healthcare professionals and service providers, and not by Pocezy.

3. Eligibility

You may use the Platform only if:

  • You are legally capable of entering into a binding agreement under applicable law; and
  • The information provided by you is accurate and complete.

Where a parent, legal guardian or authorised representative uses the Platform on behalf of another person, that person represents that they have the necessary authority to do so.

4. Account Registration

Certain features may require you to create an account or verify your mobile number, email address or other information.

You are responsible for:

  • Providing accurate information;
  • Keeping your login credentials and verification information confidential;
  • All activities carried out through your account; and
  • Informing the Hospital promptly if you believe your account has been accessed without authorisation.

The Hospital reserves the right to suspend or terminate accounts where it reasonably believes that an account is being misused, fraudulent activity is occurring, or these Terms are being violated.

 

5. Healthcare Disclaimer

The Platform is intended to facilitate access to healthcare services and information. It is not intended to replace professional medical advice, diagnosis or treatment.

Information displayed through the Platform, including general health information, educational material, reminders and other content, should not be treated as a substitute for consultation with a qualified healthcare professional.

Medical decisions should be made by you in consultation with an appropriately qualified healthcare professional.

The Platform should not be used for medical emergencies. In an emergency, immediately contact the appropriate emergency service or visit the nearest emergency medical facility.

6. Doctors and Healthcare Professionals

Information about doctors, specialists, departments, services, availability and appointment slots is provided for convenience and may change from time to time.

An appointment request or booking does not guarantee a particular medical outcome, diagnosis or treatment.

Doctors and healthcare professionals are responsible for their professional medical opinions, diagnoses, prescriptions and treatment decisions, subject to applicable law and the Hospital’s policies.

7. Appointments

Where appointment booking is available:

  • You are responsible for selecting the appropriate doctor, department, date and time;
  • Appointment availability may change;
  • The Hospital may reschedule or cancel appointments due to operational or medical reasons;
  • You may be required to comply with the Hospital’s cancellation, rescheduling and no-show policies; and
  • Additional charges may apply for certain services.

The applicable appointment confirmation displayed through the Platform will govern the booking.

 

8. Payments

The Platform may enable payments for healthcare or related services.

Payments may be processed through third-party payment gateways or financial service providers. By making a payment, you agree to the applicable terms of the relevant payment service provider.

The Hospital will not ordinarily store complete payment card information unless expressly stated in the Privacy Policy and permitted under applicable law.

Refunds, cancellations and payment disputes will be governed by the Hospital’s applicable policies and/or the terms displayed at the time of the transaction.

9. Third-Party Services

The Platform may integrate with third-party services, including payment gateways, diagnostic providers, pharmacy providers, communication providers, analytics providers, cloud infrastructure providers and other service providers.

Such third-party services may have their own terms and privacy policies.

The Hospital will take reasonable steps to ensure that third-party service providers handling personal information on its behalf are subject to appropriate contractual and security obligations.

10. User Responsibilities

You agree not to:

  • Provide false, misleading or fraudulent information;
  • Use another person’s account without authorisation;
  • Attempt to gain unauthorised access to the Platform;
  • Interfere with or disrupt the Platform;
  • Introduce viruses, malware or other harmful code;
  • Reverse engineer or attempt to extract source code from the Platform, except where permitted by applicable law;
  • Use the Platform for unlawful purposes;
  • Copy, reproduce, distribute or commercially exploit Platform content without permission;
  • Use automated systems to access the Platform in a manner that may disrupt its operation; or
  • Misuse healthcare, appointment, payment or other services provided through the Platform.

11. Intellectual Property

The Platform, including its software, design, user interface, text, graphics, logos, trademarks, content and other materials, is owned by or licensed to the Hospital and/or its technology partners.

The Hospital grants you a limited, non-exclusive, non-transferable and revocable right to use the Platform for your personal and lawful purposes.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

12. Patient Information and Medical Records

Where the Platform provides access to medical information, reports, prescriptions or other healthcare records, such information is provided for the relevant patient’s use and healthcare management.

You are responsible for maintaining the confidentiality of information accessed through your account.

The Hospital may correct, update, restrict or otherwise manage medical records in accordance with applicable law, professional requirements and its internal policies.

13. Communications and Notifications

By using the Platform, you may receive service-related communications including:

  • Appointment confirmations and reminders;
  • Payment confirmations;
  • Reports and prescription notifications;
  • Service updates;
  • Important healthcare-related notifications;
  • Account and security notifications.

Where permitted by applicable law, you may also receive promotional or marketing communications. You may opt out of promotional communications using the available unsubscribe or communication preference mechanisms.

Service and security communications may continue even if you opt out of promotional communications.

 

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, disclose and protect your personal and health-related information.

Please read the Privacy Policy carefully before using the Platform.

15. Data Security

The Hospital and its technology service providers will implement reasonable technical and organisational measures designed to protect personal information against unauthorised access, disclosure, alteration, loss or destruction.

However, no electronic transmission or storage system can be guaranteed to be completely secure.

You acknowledge that you use the Platform at your own risk and should take reasonable steps to protect your account and device.

16. Availability of the Platform

We may modify, suspend or discontinue any part of the Platform from time to time for maintenance, security, technical, operational or other reasons.

We do not guarantee that the Platform will always be available, uninterrupted, error-free or compatible with every device or operating system.

17. Accuracy of Information

We make reasonable efforts to keep information on the Platform accurate and current. However, information such as doctor availability, appointment slots, service prices, operating hours and other operational information may change.

The Hospital reserves the right to correct errors or update information at any time.

 

 

 

18. Limitation of Liability

To the maximum extent permitted by applicable law, the Hospital and its technology service providers shall not be liable for indirect, incidental, special, consequential or punitive losses arising from your use of or inability to use the Platform.

Nothing in these Terms shall exclude or limit liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the Hospital and its authorised service providers from claims, losses, liabilities and expenses arising from:

  • Your misuse of the Platform;
  • Your violation of these Terms;
  • Your violation of applicable law; or
  • Your unauthorised use of another person’s account or information.

20. Account Deletion

If the Platform allows you to create an account, you may request deletion of your account through the account deletion functionality available within the Platform or by contacting us using the details provided below.

Upon receiving a valid deletion request, we will process the request in accordance with applicable law and our data retention obligations.

Certain information may need to be retained where required or permitted by law, including information necessary for legal, regulatory, accounting, security, fraud prevention or legitimate healthcare record-keeping purposes.

21. Changes to These Terms

We may update these Terms from time to time.

The updated Terms will be made available through the Platform or website. Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

 

22. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, courts having jurisdiction over Hyderabad, Telangana, India shall have jurisdiction over disputes arising from these Terms or your use of the Platform.
